  • Rights and Responsibilities: The possessory conservator, in the context of conservatorship, is the parent who has visitation rights but does not share equal rights and responsibilities regarding the child's upbringing. This arrangement is common when the court determines that joint managing conservatorship or sole managing conservatorship is not in the child's best interests.

Conservatorship Rights: Medical, Mental Health, and Educational Decisions

Of the many rights and duties that will be included in a child custody order, the following rights tend to be the ones that most parents feel have the largest impact on their children’s lives. 

Right to Make Medical Decisions Involving Invasive Procedures:

  • Joint Managing Conservators (JMC): When parents are joint managing conservators, both have the right to make non-emergency medical decisions involving invasive procedures for the child. This right does not impact a parent’s ability to take the child for regular doctor’s visits. It also does not impact a parent’s ability to consent to medical treatment in emergency situations. 
  • Sole Managing Conservator (SMC): With sole managing conservatorship, one parent has exclusive authority over non-emergency medical decisions involving invasive procedures. The possessory conservator may still have access to medical information but typically cannot make medical decisions.
