During the hearing, the judge will determine whether or not a longer Family Violence Protective Order is necessary. An Family Violence Protective Order can be issued for varying durations, typically up to two years, but can be extended if necessary.
  • Restrictions: These orders can include restrictions such as requiring the alleged perpetrator to stay away from the victim, their residence, workplace, or school.
  • Firearms Surrender: In cases involving family violence, Family Violence Protective Orders can require the alleged perpetrator to surrender any firearms they possess.

Temporary Restraining Orders (TROs)

  • Enforcement:  The biggest key difference between protective orders and temporary restraining orders is enforcement of the order if the person subject of the order violates it. With a family violence protective order, the protected persons can call the police if the order is being violated. In most cases, the police will enforce the protective order, which could include arresting the offender. Temporary restraining orders are enforced through the courts instead of through law enforcement. If the restraining order is violated, the relief may not be as instantaneous as when a protective order is violated due to having to have the matter heard by the court.
